SMS and Messaging Terms

These SMS and Messaging Terms ("Messaging Terms") explain how SMS marketing messages are sent through the Branded Bites Platform on behalf of restaurants. These Terms apply to you as a restaurant guest who has opted in to receive text messages from a restaurant powered by Branded Bites. Branded Bites LLC provides the messaging infrastructure; the restaurant whose messages you are receiving is responsible for the content and your opt-in consent.

How to Opt In

You may receive SMS marketing messages from a restaurant powered by Branded Bites only if you have explicitly opted in. Opt-in methods may include:

  • Entering your phone number in an opt-in form on the restaurant's ordering website or mobile app and checking a consent checkbox.
  • Texting a keyword (such as "JOIN" or a restaurant-specific keyword) to the restaurant's SMS short code or long code number.
  • Checking an opt-in box at checkout on the restaurant's ordering platform.

By opting in, you consent to receive recurring automated marketing text messages from the restaurant. Consent is not required as a condition of purchasing goods or services.

Message Frequency and Content

Message frequency varies by restaurant. You may receive promotional offers, loyalty rewards notifications, order updates, re-engagement messages, and other marketing content. The restaurant is solely responsible for message content and frequency.

Messages are typically sent from a 10-digit long code (10DLC) number registered in the name of the restaurant or Branded Bites on behalf of the restaurant, in compliance with the CTIA Messaging Principles and carrier requirements.

How to Opt Out

To stop receiving SMS messages from a restaurant, reply STOP to any message. You will receive one final confirmation message, and no further messages will be sent. To re-subscribe at a later time, text START or the opt-in keyword.

You can also manage your messaging preferences through the restaurant's ordering app (if applicable) or by contacting the restaurant directly. If you need assistance opting out, you may also contact Branded Bites at ${company.email}.

For help with messages, reply HELP to any message you receive. You may also contact the restaurant directly or reach Branded Bites at ${company.email} or ${company.address}.

Carrier Message and Data Rates

Message and data rates may apply. These are charges from your mobile carrier for sending and receiving text messages. Branded Bites and the restaurant are not responsible for your carrier's charges. Contact your carrier for details on your messaging plan.

TCPA and Applicable Law

SMS messages are sent in compliance with the Telephone Consumer Protection Act (TCPA), FCC regulations, and applicable state laws. The restaurant using the Branded Bites Platform is the Sender under applicable law and is responsible for maintaining records of your consent to receive messages. Branded Bites, as the Platform provider, facilitates message delivery.

If you believe you have received a message without your consent or in violation of your opt-out request, please contact us immediately at ${company.email} so we can investigate and take corrective action.

Privacy

Your phone number and message engagement data are processed in accordance with our Privacy Policy. As described in that Policy, when you provide your phone number to a restaurant powered by Branded Bites, the restaurant is the controller of that data, and Branded Bites processes it as a service provider on the restaurant's behalf.

We do not sell your phone number or message engagement data to third parties, and we do not use it for our own marketing without a separate opt-in.
